These Terms of Service apply to all purchases made through MitigateRisk360 at mitigaterisk360.com.

By using this website or purchasing a digital product from MitigateRisk360, you agree to these Terms.

1. About MitigateRisk360

MitigateRisk360 provides downloadable digital safety document packs, including written safety programs, risk assessment tools, leadership communication documents and supporting guidance.

2. Products

Our products are digital document packs. They may include, depending on the product purchased:

  • Written Safety Program PDF documents
  • Interactive Risk Assessment Tools
  • 3 Whys leadership communication documents
  • Read Me or deployment guidance
  • Supporting digital templates or related files

No physical product is supplied unless clearly stated on the product page.

3. Purpose of the Products

MitigateRisk360 products are designed to support workplace safety management, communication, risk assessment and local safety program development.

They are templates and guidance materials. They are not a substitute for competent professional advice, legal advice, statutory inspection, engineering assessment, occupational health advice, fire risk assessment, asbestos survey, or any other specialist assessment required by law or by site-specific risk.

4. Competent Person Review Required

Before using any MitigateRisk360 product, the purchasing organisation must review and adapt it to suit:

  • local law and regulation
  • site conditions
  • task-specific risks
  • operational requirements
  • company procedures
  • worker competence
  • equipment, materials and environment
  • applicable regional, national and local requirements

MitigateRisk360 does not guarantee that a template, used without local review and adaptation, will make a workplace legally compliant.

5. Regulatory References

MitigateRisk360 resources may refer to recognised safety expectations, including OSHA, EU / EU-OSHA and UK HSE references.

These references are included to support good practice and safety alignment. They do not remove the buyer’s responsibility to check the law that applies in their own country, region, state, province, site or industry.

Where local legal requirements are stricter than a MitigateRisk360 template, the stricter local requirement must be followed.

6. Orders

When you place an order, you are making an offer to purchase the selected digital product.

An order is accepted when payment is confirmed and the digital product is made available for download or access.

We reserve the right to refuse or cancel an order where:

  • payment fails
  • fraud or misuse is suspected
  • incorrect pricing or product information has been displayed by mistake
  • the product is unavailable due to technical error
  • the order breaches these Terms

7. Prices and Payment

Prices are shown in pounds sterling unless stated otherwise.

Payment is taken through the payment methods available at checkout. We do not store your full card details.

Prices may change from time to time. A price change will not affect an order already accepted.

Where VAT or other tax applies, this will be handled according to the checkout, platform, and applicable tax requirements.

8. Digital Delivery

Products are delivered digitally. After successful payment, the customer will receive access to the purchased file or files by download link, email, customer account access, or another digital delivery method.

You are responsible for ensuring that the email address entered at checkout is correct.

UK online selling rules require businesses to confirm the contract no later than when digital content is downloaded or supplied, and to provide contract information in a durable format such as email.

9. Licence to Use Digital Products

When you purchase a MitigateRisk360 product, you receive a limited, non-exclusive, non-transferable licence to use the product for internal business safety management purposes.

Unless the product page clearly states otherwise, you may:

  • download and save the product
  • use it within your own organisation
  • adapt it for your own site or business needs
  • share it internally with workers, managers, supervisors and relevant contractors for safety management purposes
  • print copies for internal business use

You may not:

  • resell the product
  • upload it to a public website
  • sell modified versions
  • claim you created the original template
  • distribute the product as part of another commercial product
  • share the product with other businesses as a free or paid resource
  • remove MitigateRisk360 copyright or ownership notices unless expressly permitted
  • use the product to create a competing template library or document pack business

10. Digital Downloads and Cancellation Rights

Because our products are digital downloads, cancellation rights are treated differently from physical goods.

Where you are purchasing as a consumer, you normally have cancellation rights for online purchases. However, for digital content supplied immediately, you may lose the right to cancel once download or access begins if you have given express consent to immediate supply and acknowledged that you will lose your cancellation right. UK guidance recognises that downloads and streaming services have different cancellation rules.

At checkout, we may ask you to confirm words to this effect:

“I agree to immediate access to the digital content and understand that I may lose my right to cancel once the download or access begins.”

If you do not agree to immediate access, we may delay supply until the cancellation period expires or may be unable to complete the digital order.

11. Refunds

Because MitigateRisk360 products are digital files, refunds are not normally provided once the product has been downloaded or accessed, unless required by law.

We may provide a refund or replacement where:

  • the wrong product was supplied
  • the file is corrupt and cannot be accessed
  • the download link fails and we cannot resolve it
  • the product materially differs from the description
  • a refund is required under applicable consumer law

We do not normally provide refunds where:

  • you changed your mind after downloading
  • you no longer need the product
  • you purchased the wrong topic by mistake
  • your organisation decides not to use the product
  • you expected the template to remove the need for competent local review
  • you failed to read the product description before purchase

12. Faulty Digital Content

If a digital product is faulty, inaccessible, corrupted or not as described, contact us and we will aim to repair, replace or reissue the file.

UK consumer protection rules for digital content may give customers rights to repair, replacement or price reduction where digital content does not conform to the contract.

Nothing in these Terms removes statutory rights that cannot legally be excluded.

13. Customer Responsibility

You are responsible for how you use, edit, deploy and communicate the products.

You must ensure that:

  • documents are reviewed by competent persons
  • local legal requirements are checked
  • risk assessments reflect actual site conditions
  • workers receive appropriate training and briefing
  • controls are implemented and verified
  • records are retained where required
  • specialist advice is obtained where necessary

MitigateRisk360 is not responsible for incidents, injuries, enforcement action, losses, claims or non-compliance caused by misuse, non-use, incorrect adaptation, failure to implement controls, or reliance on templates without competent local review.

14. No Guarantee of Compliance

MitigateRisk360 products are intended to support safety management. They do not guarantee compliance with OSHA, EU, UK HSE or any other legal requirement.

Compliance depends on many factors, including local law, site conditions, task risk, worker behaviour, management control, training, supervision, inspection, maintenance, contractor control and record keeping.

15. Intellectual Property

All MitigateRisk360 products, templates, wording, layout, structure, branding, designs, documents, tools and supporting materials are owned by MitigateRisk360 or licensed to MitigateRisk360.

You must not copy, reproduce, resell, publish, distribute or commercially exploit our products except as permitted under these Terms.

16. Website Use

You agree not to use this website to:

  • commit fraud
  • upload malicious code
  • attempt unauthorised access
  • interfere with site operation
  • copy or scrape content for commercial use
  • infringe intellectual property rights
  • misuse checkout, download or customer account functions

We may restrict access where misuse is suspected.

17. Account and Download Security

If customer account access is provided, you are responsible for keeping login details secure.

Download links must not be shared publicly or distributed outside your organisation unless expressly permitted.

We may limit, suspend or disable access where excessive downloading, unauthorised sharing, suspected piracy or misuse is identified.

18. Product Updates

We may update products from time to time.

A purchase does not automatically include lifetime updates unless this is clearly stated on the product page.

Where we provide updated files, we may do so as a courtesy or as part of a specific product offer.

19. Third-Party Platforms and Services

This website may use third-party services for hosting, payment, checkout, digital delivery, analytics, email or other functions.

We are not responsible for delays, outages or failures caused by third-party systems, but we will take reasonable steps to assist where a customer cannot access a purchased product.

20. Limitation of Liability

To the fullest extent permitted by law, MitigateRisk360 will not be liable for:

  • indirect losses
  • loss of profit
  • business interruption
  • loss of contracts
  • loss of goodwill
  • enforcement action
  • safety incidents
  • injury or property damage arising from customer implementation decisions
  • failure to adapt templates to local requirements
  • reliance on templates without competent review

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or statutory rights that cannot be excluded.

21. Business and Consumer Customers

Some customers may purchase as businesses and some may purchase as consumers.

Where you purchase for business use, you confirm that the product is being purchased for professional, commercial or organisational use.

Where you purchase as a consumer, nothing in these Terms affects legal rights that cannot be excluded.

22. Privacy

Use of personal information is handled according to our Privacy Policy.

23. Changes to These Terms

We may update these Terms from time to time.

The Terms that apply to your order are the Terms in force at the time your order is placed.

24. Governing Law

These Terms are governed by the laws of England and Wales, unless mandatory consumer law in another jurisdiction applies.

Any dispute will be subject to the courts of England and Wales, unless applicable law gives the customer the right to bring a claim elsewhere.
